B.  Standard of Review

            Azusa Pacific argues that the trial court’s order denying Mt. San Jacinto’s motion for
summary judgment should be reviewed under the “abuse of discretion” standard. 
This is incorrect.  An order granting or denying summary judgment is reviewed de novo. 
(Buss v. Superior Court (1997) 16 Cal.4th 35, 60.) 
Accordingly, we independently
review
whether the trial court erred in denying the motion.
