B.  General Principles of Preemption  

     Under the California Constitution, “[a] county or city may make and enforce within its limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws.”  (Cal Const., art XI, § 7.)  “‘“Local legislation in conflict with general law is void.”’”  (Morehart v. County of Santa Barbara (1994) 7 Cal.4th 725, 747.)  A conflict exists if the local law “‘“duplicates, contradicts, or enters an area fully occupied by general law, either expressly or by legislative implication.”’”  (Sherwin-Williams Co. v. City of Los Angeles (1993) 4 Cal.4th 893, 897, quoting Candid Enterprises, Inc. v. Grossmont Union High School Dist. (1985) 39 Cal.3d 878, 885; People ex rel. Deukmejian v. County of Mendocino (1984) 36 Cal.3d 476, 484, overruled on other grounds in Professional Lawn Care Ass’n. v. Milford (6th Cir. 1990) 909 F.2d 929, 933.) 

     A statute representing the state’s regulation of a subject, preempts local regulation on the same subject, when that subject requires uniform treatment throughout the state. (Chavez v. Sargent (1959) 52 Cal.2d 162, 176-177, overruled on other grounds in Petri Cleaners, Inc. v. Automotive Employees, etc., Local No. 88 (1960) 53 Cal.2d 455, 473-475; Tolman v. Underhill (1952) 39 Cal.2d 708, 712.)  Even if the wording of the local law does not conflict with the statute, it is preempted because  dual regulation of the same subject would inevitably result in a conflict of jurisdiction.  (Chavez v. Sargent, supra, 52 Cal.2d at pp. 176-177.)
