DISCUSSION

1. Applicable Standards of Review

The trial errors IBC raises require two different standards of review. In reviewing a claim of instructional error, we must “assume the jury might have believed [appellant’s] evidence and if properly instructed, might have decided in [appellant’s] favor. [Citations.]” (Logacz v. Limansky (1999) 71 Cal.App.4th 1149, 1152, fn. 2, quoting Shell Oil Co. v. Winterthur Swiss Ins. Co. (1993) 12 Cal.App.4th 715, 773.) Thus, the evidence must be viewed in the light most favorable to IBC. (Henderson v. Harnischfeger Corp. (1974) 12 Cal.3d 663, 674.)
